- Identifying the ministry, bureau and division that actually own your issue, building an argument with an evidence base a Japanese official can use internally, and engaging consistently rather than transactionally. In practice it also means understanding the ruling party's own policy review, which most foreign organisations miss entirely, and which is frequently where a bill's contours are settled.
- Can a consultancy engage the government on our behalf?
- Yes, and in more than one mode. We act on a client's behalf where that is the right arrangement, and we also engage as a direct representative of the client, carrying the client's business cards where the situation calls for it, effectively operating as an extension of their team. Which mode fits depends on the issue, the counterpart and how the company wants to be seen. What is worth planning for is the narrower set of moments where a company's own senior executives should be visible in the room, typically where the discussion turns on the company's own commitment to Japan rather than on technical detail. We advise on where that line falls rather than applying a fixed rule.
- Is lobbying regulated in Japan?
- Japan has no lobbying registration regime comparable to the United States, and the word itself carries a different connotation. What governs conduct instead is a combination of political funds regulation, rules on gifts and hospitality to public officials, and strong professional norms inside the bureaucracy. The practical constraint is reputational and relational rather than a filing requirement.
- Which ministry regulates our business?
- It depends on your sector, and it is rarely only one. Most companies identify the ministry that licenses them and stop, missing the cross-cutting regulators that apply regardless of sector: data protection, competition, labour, and foreign investment screening.
